TACHOGRAPH REPLACEMENT
1. LEGAL BASES
The obligation to replace tachographs results from the provisions of Regulation (EU) No. 165/2014 and the Act on Tachographs, Journal of Laws 2024.1037.
Key dates
From 21 August 2023: Newly registered heavy goods vehicles must have smart 2 tachographs.
Until 31 December 2024: Vehicles already used in international transport with analogue or digital tachographs must be equipped with smart 2.
Until 18 August 2025: Vehicles with Smart 1 tachographs must be upgraded to smart 2
From 1 July 2026: The smart 2 tachograph will be mandatory for all heavy goods vehicles weighing over 2.5 tonnes used for international transport.
Legal basis:
Regulation (EU) No. 165/2014 – specifies requirements for the construction, installation and use of tachographs.
Commission Implementing Regulation (EU) 2016/799 – establishes detailed technical requirements for tachographs.
Tachograph Act Dz.U.2024.1037 – regulates the conditions for conducting activities in the field of installation and inspection of tachographs.
2. OBLIGATION TO REPLACE THE TACHOGRAPH
New regulations on tachographs will come into force on 1 January 2025, which aim to improve safety and compliance with road transport regulations. Here are the most important changes:
Obligation to replace tachographs:
Vehicles equipped with first-generation analogue or digital tachographs must be upgraded to second-generation smart tachographs (G2V2) by 31 December 2024.
August 18, 2025 is the deadline for replacing G2V1 tachographs with G2V2.
Costs and penalties:
Replacing a tachograph can cost several thousand zlotys (purchase of the device, installation, calibration).
Companies that fail to adapt vehicles to the new regulations may receive an administrative penalty of up to PLN 10,000, and transport managers may be fined up to PLN 2,000.
New functions of G2V2 tachographs ✔ Automatic registration of border crossings. ✔ Recording of loading and unloading times and positions. ✔ Possibility of remote data reading by inspections.
